New UK immigration law introduces tougher English Language tests for migrants

The UK government has announced new immigration rules that will require migrants to meet new levels of English language standards.

Also introducing changes to student and work visa rules, under a law put before Parliament on October 14th.

Under the new rules, migrants applying through certain legal routes must pass an English language test equivalent to an A-level standard in speaking, listening, reading, and writing.

This Secure English Language Test must be conducted through an approved provider, and results will be verified during the visa application process.

Home Secretary Shabana Mahmood said: “If you come to this country, you must learn our language and play your part.”

Changes to International Student Visa Rules

The time allowed for international students to stay and seek graduate-level employment after completing their studies will be reduced from two years to 18 months, effective from 1 January 2027. This adjustment follows data indicating many students had not transitioned into graduate-level jobs as expected.

In addition, financial requirements for student visas will increase for the 2025–2026 academic year, requiring students to demonstrate sufficient funds to support themselves during their studies.

Increased Immigration Skills Charge

The Immigration Skills Charge (ISC), paid by employers sponsoring skilled foreign workers, will rise by 32%—the first increase since 2017. Revenue from the ISC will be reinvested in training British workers to reduce dependency on overseas recruitment. The Parliamentary process to approve this increase will begin later this week.

New Routes to Attract Highly Skilled Talent

Details inform that the government is expanding its High Potential Individual (HPI) visa route to include graduates from the top 100 international universities, increasing the cap from 2,000 to 8,000 applications per year. This change is expected to double the number of HPI visa holders in the UK.

Entrepreneurs graduating from UK universities will have a simplified pathway to establish businesses through the Innovator Founder visa route after their student visas expire.

Enhancements are also being made to the Global Talent visa route, including expanding the list of recognised awards and adjusting requirements for architects.

The government, as stated, seeks to double the number of highly skilled migrants entering the UK through these routes, including researchers, designers, and creative professionals in the film and TV sectors. Further changes to the Global Talent route are planned for 2026.

Next Steps in Immigration Reform

These changes, as informed, are part of the government’s immigration white paper and Plan for Change, which looks to reform the UK’s immigration system. More changes, including on asylum and border security, are expected later this autumn.
